The High Court has overturned the acquittal of twin brothers Tai Ka-ching and Tai Ka-ping, who were previously found not guilty of vandalizing the Hey Tea branch at New Town Plaza in Sha Tin during the 2020 Hong Kong protests.
The brothers, both 20 and students, faced charges related to property damage, including destruction of a cash register display and an Octopus card processor, along with resisting arrest.
In its ruling on April 7, the High Court found the original magistrate’s verdict illogical, directing the case back for further consideration.
While the magistrate had previously concluded that the prosecution did not prove the defendants’ identities beyond reasonable doubt, video footage identified Tai Ka-ching through his clothing, which was overlooked in the initial ruling.
Additionally, the evidence was deemed sufficient to establish Tai Ka-ping’s involvement in damaging the store.
This decision underscores the importance of fully assessing all available evidence in cases involving public disorder and holds the potential for renewed accountability for the vandalism at Hey Tea.
